102 Kirinyaga Residents Move to Court to Bar MPs Report Against Anne Waiguru

102 Kirinyaga residents moved to court on Tuesday seeking to squash a report filed by Public Accounts Committee (PAC) against former Kirinyaga Gubernatorial Aspirant Anne Waiguru.

The residents sued the National Assembly, Ethics and Anti-Corruption Commission, Directorate of Criminal Investigations and the Attorney-General Githu Muigai claiming that locking the former Devolution Cabinet Secretary out of the August 2017 race would be violating their right to choose a leader of their choice

In their court papers, the residents argued that PAC took over the role of the Ethics and Anti-Corruption Commission irregularly when it investigated the matter adding that Waiguru was denied the chance to cross-examine all those testified against her.

"Petitioners are apprehensive Waiguru's ethical fitness to contest for the seat may be based on the PAC's report which is erroneous, unlawful and offending," the court papers read. 

This follows PAC recommendations that were adopted by the National Assembly to bar Waiguru from holding public office if found guilty of the loss of Sh 791,385,000 at NYS.

Waiguru later moved to court stating that the recommendations by PAC were reached on the basis of uncorroborated and false evidence by an affidavit by one of the key suspects, Josephine Kabura.

Through her Lawyer Issa Mansur, the Gubernatorial hopeful further argued that there was no new evidence to warrant a decision for fresh investigations against the former CS and as such, the decision by PAC to block her was an abuse of office.

The Kirinyaga Governorship aspirant denied involvement in the scandal, stating that her name was brought in as a scapegoat to hide those behind the looting.
