Former Devolution Cabinet Secretary Anne Waiguru Moves to Court to Block Lifestyle Audit

Kirinyaga Gubernatorial aspirant Anne Waiguru on Monday moved to court to challenge the National Assembly Public Accounts Committee (PAC) recommendations that she should be held responsible for the National Youth Service (NYS) scandal that led to the loss of over Sh 719 Million.

The Former Devolution Cabinet Secretary (CS) sued Parliament, the Ethics and Anti-Corruption Commission (EACC), the Director of Criminal Investigations (DCI) and the Attorney General.

Through her lawyer Mansur Issa, the Gubernatorial hopeful argued that the recommendations by PAC were reached on the basis of uncorroborated and false evidence by an affidavit by one of the key suspects, Josephine Kabura.

"PAC relied on uncorroborated, contradictory and false evidence of Josephine Kabura in her affidavit of February 23, 2016. The claims were the subject of investigations which concluded Kabura lied on oath and recommended she be charged with false swearing," Mansur submitted.

Waiguru's lawyer further argued that there was no new evidence to warrant a decision for fresh investigations against the former CS and as such, the decision by PAC to block her was an abuse of office.

The Kirinyaga Governorship aspirant, in her sworn affidavit, denied involvement in the scandal, stating that her name was brought in as a scapegoat to hide those behind the looting.

The Former CS now wants the court to declare as null and void, the PAC report on the multi-billion shilling National Youth Service (NYS) scandal and issue orders barring EACC from conducting a thorough lifestyle audit on her and fresh investigations as well as probable prosecution.

Last week, the National Assembly adopted PAC recommendations that barred Waiguru from holding public office if found guilty of the loss of Sh 791,385,000 at NYS and that the DCI starts fresh investigations on her over abuse of office.
