Lawyer Harrison Kinyanjui Orders Police to Arrest Raila Odinga and Kalonzo Musyoka

One of the lawyers who was representing interested parties during the Presidential election petition has demanded the investigation, arrest and prosecution of National Super Alliance (NASA) leaders Raila Odinga and Kalonzo Musyoka.

In a letter to the Director of Criminal Investigations (DPP), Harrison Kinyanjui called for the arrest of the two Opposition Leaders for continuously stating that there will be no elections on October 26.

Kinyajui further asked the DPP to charge Raila and Kalonzo with breach of the Election Act for harassing and intimidating Independent Electoral and Boundaries Commission (IEBC) officers.

The letter read in part, "We demand for the investigation, arrest and prosecution of Stephen Kalonzo Musyoka and Raila Amollo Odinga for uttering and repeating that statements to the effect that there will be no presidential election on October 26, 2017, as declared and set by the IEBC notwithstanding that the Supreme Court of Kenya ordered on September 1st, 2017 that pursuant to article 140 (3) of the Constitution, the fresh presidential election be conducted by IEBC within 60 days."

Last week, Odinga opposed the new date set by the IEBC for the repeat presidential election.

He claimed that the October 26th date announced by IEBC Chair Wafula Chebukati was set by OT-Morpho, the French firm that supplied the electronic system used to transmit results in the August elections.

The NASA leader further accused IEBC of consulting President Uhuru Kenyatta in choosing the new election date which happens to be Uhuru's birthday. 

The former Prime Minister further indicated that the NASA coalition has never been involved in any kind of consultations with the IEBC since the release of the Supreme court's full verdict on nullification of the August election.

Odinga lamented that IEBC ignored NASA's suggestion that the fresh election be held on October 24th on grounds that it would affect examinations, only to settle for the new date which is just two days away.
