Ahmednasir Abdullahi Speaks on Alfred Mutua's Election Nullification

Renowned Nairobi lawyer Ahmednasir Abdullahi on Friday expressed joy following the nullification of Alfred Mutua's election as Machakos Governor, noting that it was one of the best cases he has prosecuted.

Mutua lost his seat following a successful petition by his competitor and Ahmednasir's client, Wavinya Ndeti.

"Very happy for my client Hon Wavinya Ndeti for her victory...one of the best cases I prosecuted at the Court of Appeal," wrote the Senior Counsel on his official Twitter page.

A section of netizens, however, accused him of double standards, reminding him of the Presidential petition where he was on the losing side and did not have kind words for the judges.

Speaking after Friday's ruling, Mutua divulged that he would move to the Supreme Court to challenge the result.

"We will still be in office until the Supreme Court rules otherwise. The court didn't cover the issue of validity.

"It is very clear that the Court of Appeal misunderstood the whole case. They had some findings that are not clear where they got them from- they look like factual errors," he stated.

Earlier in February, High Court Judge Aggrey Muchelule upheld Mutua's victory and ordered Ms Ndeti to pay costs amounting to Ksh5 million to the Governor and an equal amount to IEBC.

He stated that the petitioner had failed to furnish the court with proof of any irregularities or illegalities that she claimed to have happened during the contested polls.

Elsewhere, Embakasi East MP Babu Owino's election was upheld after the Court of Appeal ruled that he was fairly elected during the August polls.
