Waluke Sentence: Ksh727M Fine or 67 Years in Jail

UPDATE: The Judiciary clarified that the total jail terms for convicts in Ksh314 Million maize scam are 69 years for Wakhungu and 67 years for Waluke if the cumulative fine amounting to Ksh2.1 Billion is not paid.

Magistrate Juma in a statement stated that if the fines she set are not paid, the two convicts will serve their own terms.

The directors of the company would serve on its behalf if the company did not pay its own fine.


Sirisia MP John Waluke and co-accused Grace Wakhungu were on Thursday, June 25, fined Ksh727 million and  Ksh707 million respectively, or serve 10 years in jail each upon default for fraudulently receiving Ksh297 million from the National Cereals and Produce Board (NCPB).

In her ruling, Chief Magistrate Elizabeth Juma issued fines of varying amounts to the accused with the highest being a fine of Ksh594,175,000 or a jail sentence of seven years on the third count.

Wakhungu's fines totaled to Ksh707.7 Million as she was issued with fines in accordance with sentencing laws when it came to corruption cases.

The two were charged alongside Erad Supplies & General Contracts Limited (Erad); a company where the two are shareholders.

Juma ordered that the conviction for Waluke be served to the speaker of the National Assembly and the Public Service Commission (PSC)

She further noted that if the fine is paid, NCPD will be compensated for the amount lost.

Waluke was represented by Lawyers Evans Ondieki, Samson Nyamberi, Cliff Ombeta and Dunstan Omari while Assistant Deputy Director of Public Prosecutions Alexander Muteti, Gitonga Riungu, and Mercy Gateru represented the state in the matter.

2) Count 2 - Ksh100,000 (or 1 year in jail)

3) Count three - Ksh 500,000 (or three years in prison ) + 594,175,000 which is double the amount NCPB lost (or 7 years in prison )
