Law Society of Kenya CEO Mercy Wambua sued Nelson Havi for what she described as contempt of court as interviews to find her replacement begin on Wednesday, July 21.
The CEO argued that her contract was to end in February 2022 and replacement plans violate her rights.
Wambua insisted that she was ready to fight for her position and that she had sued Havi for defying a court order issued in 2020 barring the LSK President for instituting leadership changes.
Her move to court comes just after LSK announced its plans to interview the two shortlisted candidates, Mutua Ngumbau and Mutunga Mutisya, at 10.20 am and 11.20 am respectively at its headquarters on Gitanga Road.
Juliette Akoth Jakalia was also shortlisted for the interviews.
“One of the court orders that I got last year stated that he (Havi) should not interfere with my contract. He is basically interfering with my contract. I have already filed a contempt of court application and he risks being jailed for six months,” Wambua told Nation.
Wambua was reportedly kicked out when 118 LSK members supported her ouster motion, with only 18 opposing.
The latest suit comes barely a week after he was detained at DCI headquarters for allegedly assaulting Wambua during a meeting.
Havi dismissed the allegations going further to obtain orders barring the prosecutor from pushing on with the case.
Talking to Kenyans.co.ke, Havi declined to comment on the matter.
