A Spanish national has told a Nairobi court that his life was in danger after losing Ksh176 million to three Kenyans.
Eduardo Hernandez De La Rosa Ciriza told Milimani Chief Magistrate, Francis Andayi, that his brother died mysteriously after an argument with a director of a company he has invested in.
According to Ciriza, his brother collapsed and died mysteriously in the Nairobi Central Business District (CBD), but the matter was not investigated.
Ciriza, who is an investor and chairman of Meridian Acceptances Limited, which is owned by the first accused James Ndwiga Muchungu, together with co-accused Ian Nyagah Ndwiga and Lisa Mumbi Ndwiga, stated that he had been threatened severally.
He told Justice Andayi that his family invested more than Ksh380 million in the company but things turned sour between his family and the Ndwiga's.
The Spaniard told the court that James Ndwiga took control of the company and denied him access to the premises yet he is the firm's chairman.
”All the accused persons are relatives and the first accused kicked out all the employees, changed locks and have denied me access to the company since January 2021 yet my family and I were the sole investors having pumped into the company more than Ksh380 million,” Ciriza submitted in court.
Eduardo Hernandez De La Rosa Ciriza, while seeking to have the three suspects detained until the case is heard and determined, said that his life was in danger. The request was, however, denied.
The three sought to be released on lenient bail terms stating that they will abide by all conditions given by the court.
Justice Andayi ordered the first accused James Ndwiga to be released on Ksh1.5 million bail while his co-accused were released on Ksh1 million bail each.
The three were charged with stealing Ksh176 million from Meridian Acceptances Limited.
They are also facing charges of obtaining registration of the directorship of the company by forgery and stealing Ksh53 million while being the directors of Meridian Acceptances Limited.
