Deputy President William Ruto's United Democratic Alliance (UDA) has written a demand letter to Sports Kenya following the latter's decision to deny him access to Nyayo Stadium for his final rally scheduled for August 6.
In the letter seen by Kenyans.co.ke, UDA - through lawyers Adrian Kamotho Njenga and Advocates - demanded that Sports Kenya recalls the cancellation notice that was sent to the party on the unavailability of the venue.
UDA argued that Sports Kenya had breached its contract by revoking the booking of the facility by Kenya Kwanza for its final rally.
"Take note that our instructions are to demand, which we hereby do, the immediate withdrawal or revocation or cancellation of the illegal letter by yourself dated July 20," the letter read in part.
The law firm noted that Sports Kenya had violated contractual privilege and the rights of membership of UDA supporters as enshrined in the constitution.
In addition, UDA dismissed the reason given for the cancellation of its reservation terming the booking for prayer concerts as nebulous (vague in nature).
While the Ruto-led party noted that it was not interested in escalating the matter into a legal battle, it threatened to move to court if the demands of the letter were not met.
"Please note that where outright impunity, breach of contract or a violation of rights is established as is the case herein, an avalanche of constitutional and statutory remedies abound," the lawyers reiterated.
They further claimed that the failure by Sports Kenya to adhere to the demand letter would result in gross monetary loss of the nation's funds.
"Any form of interference or breach of the aforesaid contract would unjustifiably subject taxpayers to humongous financial losses accruing from damages running into hundreds of millions," the demand letter read.
Apart from UDA, Azimio la Umoja announced that it would hold its homestretch rally at Nyayo Stadium on August 6, clashing with the Ruto booking as well as that of the prayer concert.
Nonetheless, the Raila Odinga team did not show proof of payments or a contractual agreement confirming the reservation of the sports complex.
