DPP Noordin Haji Gives IG Mutyambai Ultimatum on IEBC Official, Daniel Musyoka's Murder

The Director of Public Prosecutions (DPP) Noordin Haji has given the Inspector General of Police  (IG) Hillary Mutyambai an ultimatum on the probe into the murder of the Embakasi East constituency returning officer, Daniel Musyoka.

In a statement dated Thursday, August 18, Haji directed Mutyambai and the National Police Service (NPS) to expedite the investigations into Musyoka's death and file a report within seven days.

The DPP exercised the powers vested in him by Article 157 of the Constitution of Kenya (2010).

"You are hereby directed to undertake comprehensive investigations into the matters contained in the above-mentioned statement pursuant to Article 157 (4) and submit the resultant investigation file within seven days thereof," Haji wrote.

Article 157 highlights the role of the DPP, with Section (4) giving him the authority to put in a request to the police boss to probe a specific case

"The DPP shall have the power to direct the Inspector-General of the National Police Service to investigate any information or allegation of criminal conduct and the IG shall comply with any such direction," reads Article 157 (4).

Haji's order made reference to the letter written by the Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati, who called on the authorities to investigate Mulwa's death.

"It is unfortunate that his stand to do the right thing cost his life. We call on security agencies to speedily investigate his death and apprehend his killers," Chebukati petitioned.

Mulwa was found dead on August 16, in Loitoktok, five days after he went missing from the constituency tallying centre at the East Africa School of Aviation collage.

According to his colleagues, he notified them that he was briefly stepping out before the announcement of the Parliamentary and Member of County Assembly (MCA) results but never returned.

A preliminary report by Loitoktok police boss Kipruto Ruto revealed that Musyoka was killed at a different location before being dumped at the crime scene. Ruti added that the IEBC official died painfully.

A post-mortem conducted by five government pathologists at the Oloitokitok Sub-County Hospital Mortuary returned as inconclusive. The body, however, had strangulation marks.

The medical officers noted that they had taken samples for forensic assessment, adding that the murder had been professionally executed.
