A student at the University of Eldoret then known as Chepkoilel University College, a constituent college of Moi University, suffered a head injury in 2008 and was in the hospital for 4 years but the KSh10.1M medical bill is yet to be cleared.
The victim, Ekens Okemwa Mairura, during a rugby game under the University team, sustained a head injury and was rushed to the Moi Training and Referral Hospital (MTRH) for treatment where he was discharged on May 10, 2012.
According to reports made to the Eldoret High Court, the parent institution, Moi University had initially committed in writing to cover the entire bill but withdrew its words after only paying Ksh4M and asked the student's parents to clear the rest.
Through a letter dated March 17, 2011, Moi University withdrew its prior promise to carter for any pending bills.
The parents however insisted that the institution was liable for the cost and should honor its prior promise.
Furthermore, Moi University argued that after Chepkoilel University College was awarded a charter and became the University of Eldoret in 2013, it was responsible to clear its liabilities.
Eventually, in 2019, the University of Eldoret was ordered to make the payment but only paid Ksh2.8M.
In its defense, the University of Eldoret argued that Moi University committed to the hospital before the new institution was established and should therefore clear the medical bill.
However, according to the hospital, none of the two hospitals have made efforts to clear the pending Ksh3.2M bill.
Following the back and forth, the Eldoret High Court has enjoined the two varsities in the case filed by MTRH seeking to clear the payment.
“It is clear that for a just and proper determination of the issues at hand, Moi University and the University of Eldoret should be joined to these proceedings. Accordingly, prayers 2 and 3 of the motion are allowed,” Justice Eric Ogola ordered.
The two varsities have disowned the responsibility, blaming each other for the outstanding medical bill.
