Jowie Irungu Found Guilty of Monica Kimani Murder

Joseph Irungu alias Jowie has been found guilty of the murder of Nairobi businesswoman Monica Kimani which occurred in 2018.

While delivering her judgment on Friday, Lady Justice Grace Nzioka noted that the prosecution had proved to the court that the security personnel committed the offence.

"It is the finding of this court that all this evidence taken cumulatively leads to a strong conclusion that the first accused person murdered the deceased," ruled Nzioka.

"Therefore, it is the finding of this court that the prosecution has proved beyond reasonable doubt all the ingredients of the offence of murder, the death that occurred, the cause of death and the person who committed that offence. It was not a case of homicide, It was unlawful. Therefore I find the first accused person guilty as charged herein of the offence of murder."

The court determined that Jowie (the first accused) indeed knew the deceased before her death. Jowie, in his defence, had however told the court that he had never met or known the deceased.

Based on the testimony of Kimani's brother and cell phone record, the Justice determined that Jowie had known the deceased before her death. Kimani's brother told the court that they spent a night at the deceased home on August 30, 2018. 

"The 1st accused (Jowie Irungu) claimed he did not know the deceased at all. George Kimani, the deceased’s brother submitted that Jowie and Monica Kimani were in the same class in 2002 taking the same course in hotel and beverage management," the judge stated.

Regarding who was last seen with the deceased, the court agreed with the prosecution's evidence that the security personnel was the last person to be with the businesswoman before her death.

"When the Doctrine of Last Seen is applied, the law presumes that the person last seen with the deceased was responsible for their death, and the accused is supposed to present an explanation of what happened," she stated.

Similarly, Justice Nzioka agreed with the prosecution's aspersions that Jowie used a gun to intimidate the deceased before her death.

On the other hand, forensic evidence established that the blood stains on Jowie's shorts belonged to the businesswoman.

Further, the judge cancelled Jowie's bond and directed that he be held in police custody until March 8, 2024.

Former Citizen TV News Anchor Jacque Maribe, on the other hand, was acquitted of any wrongdoing.

Cause of Monica Kimani's Death

There was an irregular inversive wound on the neck caused by a sharp object when Kimani was found dead inside her apartment.

Additionally, the Court revealed that there were bruises on the wrists of both legs.

According to the Court, the person who murdered the businesswoman had military-like training and intended instant death.

Former Citizen TV anchor Jacque Maribe has been acquitted in the murder of Nairobi businesswoman Monica Kimani.

While delivering her judgement on Friday, Lady Justice Grace Nzioka noted that there was no concrete evidence to prove that the former news anchor was involved in the murder which occurred in the September 19, 2018 incident.

Maribe had been charged alongside her former boyfriend Joseph Irungu alias Jowie who was found guilty of the offence.

"The evidence of the prosecution against the second accused person did not place her in the house of the deceased on the material night. There was no evidence that she had ever communicated with the deceased."

"The result is that the prosecution did not adduce any evidence for this court to find the second accused guilty of the offence of murder of Monica Nyawira Kimani on the night of September 19, 2018," she ruled.

However, in her opinion, Justice Nzioka opined that the prosecution preferred the wrong charge against the former journalist.

As detailed by the judge, the evidence against Maribe revolved around two different statements she made to the police regarding an alleged shooting incident which police claimed was aimed at misleading investigations into Kimani's murder.

Monica Kimani was found murdered at her apartment in Nairobi in September 2018. The businesswoman had just arrived in the country from South Sudan before she was found murdered in her bathtub.

After investigations were launched into the matter, police arrested Jowie with police accusing the security personnel of murdering the businesswoman.

According to the police, Jowie was among the last people to be with the businesswoman in her apartment.

10 days after the murder incident, Maribe was arrested by police, with the former journalist accused of taking part in the murder.

35 witnesses testified in the case that has been in court for over five years

Prosecution Accusations Against Maribe

During the five-year court case, the prosecution has six accusations against the journalist as detailed below;

1. She was in the vicinity of the commission of the murder.

2. The vehicle used in the commission of the offence was hers.

3. She aided and abetted the first accused person (Jowie) by providing the car.

4. She switched off her phone at the time of the murder.

5. She gave police false information regarding a shootout involving Jowie to mislead police investigations.

6. She was aware of the destruction of evidence which would have been used in the murder case. 

Court's Findings on Maribe

"It is the finding of the court that the second accused person's statement made on the gun shooting was false," the judge ruled.

High Court Suspends Ruto's eCitizen School Fees Directive

The High Court on Wednesday suspended the government's order directing all parents to pay school fees via eCitizen.

The court issued a conservatory order suspending the implementation of the directive by the Ministry of Education pending further directions from the court on February 13.

"That an interim conservatory order is herby issued suspending the Circular or letter by the Principal Secretary (Belio R Kipsang), Ministry of Education dated 31st January 2024, requiring parents/Guardians and or students to pay fees and or any other levies for all government learning institutions through e-citizen platform or any other Digital platform(s) until 13th February 2024, when the court will issue further directions in this petition," read part of the court order.

The High Court's decision comes just a day after a doctor from Nakuru County moved to court seeking orders to have the directive quashed.

In his petition, the surgeon who works for the County government of Nakuru termed the initiative as illegal and that it violated the principles of good governance.

According to him, the programme was implemented without adequate public participation further noting that it would greatly inconvenience parents who pay their children's school fees through non-monetary means. 

On Wednesday, President William Ruto while addressing a delegation in Tokyo, Japan defended the decision stating it was geared at ensuring transparency and prudent use of funds for the benefit of learners. 

“You may have heard the latest about school fees in Kenya, or money paid by parents for example in boarding schools. We provide resources for learning in all our primary and secondary schools through what parents pay," Ruto stated.

“We are insisting because we realised there are illegal levies charged by the board of management of  schools that go into accounts that nobody knows, we have insisted that all monies charged to Kenyans must be transparent.” 

On January 31, the Ministry of Education released a notice directing all guardians whose learners are in national schools to make payments through the eCitizen platform.

"The Directorate of e-Citizen in partnership with the Information Communication Technology Authority (ICTA), Ministry of Information, Communication and the Digital Economy and the National Treasury have been coordinating the onboarding of all government services onto the eCitizen platform to enhance service delivery," the circular read in part. 

"As part of compliance with the requirements it is directed that parents/guardians make fee payments for their learners in your institutions through this platform."

While commenting on the matter, Immigration and Citizen Services Principal Secretary Julius Bitok stated the move would enhance accountability in public institutions across the country.

Bitok further noted the implementation would be done in phases, beginning with national schools and then to other schools.

Sakaja Orders Closure of Gas Plants in Residential Estates in Nairobi

Nairobi Governor Johnson Sakaja has ordered the closure of all gas businesses operating in residential areas within the county.

Sakaja, who made the declaration during a visit to the Embakasi Explosion site, stated that the directive will enhance the safety of Kenyans living in various neighbourhoods within Kenya's capital.

While delivering his remarks, the county chief ordered sub-county officials to see to it they enforce the order.

"I want to assure Nairobians that the owners of the premises where the incident took place shall be held responsible and accountable.

"I have directed all sub-county administration officers to ensure all gas businesses operating within residential areas are closed with immediate effect," he directed.

Further, the governor warned county officials against laxity during enforcement, revealing that he already had a list of similar sites whose owners will be held culpable if found to be operating illegally.

Sakaja also called on Kenyans to raise the alarm should there be gas leaks or in instances where they notice illegal gas businesses operating in their estates.

Meanwhile, the governor reiterated that the county government would continue to offer relief to those who were affected during the February 1 incident.

On his part, Nairobi Senator Edwin Sifuna revealed that the Senate Energy Committee would demand a list of gas refilling plants in the country to ensure that there is enforcement of safety regulations.

The Embakasi explosion has claimed six lives and left over 300 people nursing injuries across various hospitals within the city.

Police, on the other hand, have apprehended the owner of the gas facility alongside 3 National Environment Management Authority (NEMA) officials. 

A manhunt has also been launched for two other NEMA officials and the two drivers who are accused of contributing to the explosion.

Embakasi Explosion: NEMA Suspends 4 Govt Officials After Ruto Order

National Environment Management Authority (NEMA) has suspended four of its officials linked to the Embakasi Gas explosion.

The four include the Director of Environmental Compliance and Acting Deputy Director of Compliance.

Two other officers from the Environment Impact Assessment (EIA) were suspended. These were the Senior Environmental Officer and the Head of Environmental Impact Assessment. 

Notably, the directive was issued after President William Ruto ordered the suspension and arrest of officials accused of negligence and issuing certificates of operation to the illegal gas plant.

"The Board further requests the relevant government agencies to commence an immediate investigation. The National Environment Management Authority's Management is also hereby directed to cooperate with the already established multi-agency teams handling the incident," the statement by Emilio Mugo, the Chairman NEMA Board of Management. 

"We wish to convey our heartfelt condolences to the Kenyans who lost their lives and wish a quick recovery to the injured," the board added.  

In its preliminary investigations, the board stated that the gas plant owners forwarded an Environment Impact Assessment project report to NEMA while seeking permission to install and operate the Embakasi facility. 

This report was submitted on July 29, 2020. Two years later, in April 2022, NEMA forwarded it to various agencies for sectorial review and comments to guide on the licensing process. 

Among the agencies consulted were the Energy & Petroleum Regulatory Authority (EPRA), the Director of Physical Planning - Nairobi City, the Water Resources Authority, the Directorate of Occupational Safety and Health, Nairobi City Water & Sewerage Company and the Director of Urban Planning and Development.

On July 28, of the same year, a review of the project was done and several issues were raised with NEMA asking the gas owners to address them before another scheduled review. 

NEMA sought clarity on the land ownership and asked the owners to provide evidence of undertaking consultation with immediate neighbours of the Nyayo Estate Residents Association. The proponents of the project respond vide documents dated August 22, 2022 and February 1, 2023.

"The Project Proponent submitted a comprehensive EIA report with potential impacts identified and mitigation measures proposed in the Environmental Management Plan. A record of the decision was made to issue the proposed project with an ElA licence," NEMA stated. 

It issued the licence with conditions that the owners ought to have met, including compliance with various laws in the construction of the LPG plant.

However, the NEMA Board highlighted gaps in the issuance of the license to the LPG plant in question. Further investigations revealed that the four suspended NEMA officers unprocedurally processed the license.

"The Board therefore directs that the implicated officers step aside immediately pending further investigation by the relevant government agencies," NEMA explained its decision to adhere to Ruto's directive.

Ruto Orders Arrest of Govt Officials in Embakasi Gas Explosion

President William Ruto has ordered the dismissal, arrest and detainment of government officials who issued licences to the gas filling plant that exploded in Embakasi on Thursday night.

Speaking during the groundbreaking ceremony for Chekalini Market in Lugari, Kakamega County, Ruto explained that the gas filling plant was operational contrary to the law. 

He added that unscrupulous government officials issued permits to the gas dealer to conduct business in a residential area hence endangering Kenyan lives. 

The president thus demanded the dismissal and arrest of the government officials within 24 hours to face charges levelled against them.

"In Nairobi, there was an explosion causing grave injuries to many people because of laziness, deceit and corruption in government offices. Some granted a licence for the plant to be established at a residential area endangering the lives of Kenyans," Ruto stated.

"I have instructed the Ministry that those responsible for granting the licence should be fired, arrested and detained today," he added. 

The President further claimed that government officials received bribes to turn a blind eye to the law, which consequently led to the Thursday night explosion that claimed three lives and injured over 280 others

"They (gas filling plant owners) were instructed not to establish the facility but due to bribery and lack of discipline, the licence was issued and now we have a problem in our hands," the head of state revealed. 

Ruto's directive came hours after Energy and Petroleum Regulatory Authority (EPRA) boss Daniel Kiptoo confirmed that the gas filling plant managed other facilities in Embakasi and Nanyuki.

Kiptoo added that EPRA officials raided the facility in Nanyuki and arrested the staff. It was further established that the facility was only licensed to operate as an LPG gas transporter. 

Director-General Kiptoo added that the gas-filling plant's application for establishing the facility in Embakasi was rejected three times as it did not meet the stipulated safety measures.

Govt Orders All National Schools Parents to Pay Fees Via eCitizen

The Ministry of Education has directed all parents or guardians whose learners are in national schools to make payments through the eCitizen platform.

This is in line with the government's directive to consolidate all platforms through the pay bill number 222222.

Speaking to Kenyans.co.ke, a top-ranking official at the Ministry confirmed the directive and highlighted that it will only affect national schools in the meantime.

The government will then assess the pilot project, and assess gaps and other improvement areas before other schools are onboarded.

In a circular sent to all principals of national schools, Basic Education Principal Secretary Belio Kipsang instructed them to provide the details of the institution's bank account details to facilitate the onboarding process. 

"The directorate of e-Citizen in partnership with the Information Communication Technology Authority (ICTA), Ministry of Information, Communication and the Digital Economy and the National Treasury have been coordinating the onboarding of all government services onto the eCitizen platform to enhance service delivery," the circular read in part. 

"As part of compliance with the requirements it is directed that parents/guardians make fee payments for their learners in your institutions through this platform."

Principals were asked to submit key finance information to the office of the Director General, State Department for Basic Education before February 6, 2024. 

Among the information needed were the details of all bank accounts managed by schools in the following format.

The government will advise parents on how to pay for school fees once all bank account details are collected. 

"Please ensure that the aforementioned information is submitted to the Office of the Director General, State Department for Basic Education not later than February 6, 2024, on email dg@education.go.ke and copy to sa.basic@education.go.ke."

This is aimed at increasing the number of new users who sign up to eCitizen in addition to the existing 11 million who utilise the service daily.

In June 2023, President William Ruto directed all pay bills to be consolidated to reduce graft tendencies fostered by physical interactions in government offices.

LPG Dealers Risk Closure as Kindiki Orders Nationwide Risk Assessment

The Ministry of Interior and Coordination jointly with the Ministry of Energy and Petroleum on Friday directed that a fresh risk assessment be undertaken for all gas plants in the country with the view of closing all non-compliant sites.

CSs Kithure Kindiki and Davis Chirchir further ordered the demolition of all illegal Liquefied Petroleum Gas (LPG) sites through the Multi-Agency Rapid Results Initiative.

"Immediate rollout of Government LPG growth strategy which includes the development and implementation of a track and trace the framework for LPG cylinders to improve traceability and accountability," read part of the statement by the Ministry of Interior.

"Our teams will fully collaborate with other Government agencies to investigate this incident and prosecute any persons found in breach of the law."

Other measures included the immediate rollout of the Government LPG growth strategy which includes the development and implementation of a track and trace framework for LPG cylinders to improve traceability and accountability.

The CSs also ordered punitive administrative measures for all LPG operators found filling cylinders without the written authority of the brand owners.

Government operatives were also directed to strengthen the LPG data verification framework to improve accountability by players in the sector.

The last measure was the enhancement of public awareness and sensitisation programs to promote LPG safety. 

"We shall hold Nationwide LPG Stakeholder workshops to strengthen the policy and regulatory framework in the LPG sector," the duo stated. 

Investigations Into Embakasi Explosion

Kindiki and Chirchir confirmed that three people died and over 200 were injured in the Thursday night explosion.

The duo established that three applications were made to EPRA for a permit to construct an LPG storage and filling plant on separate dates, March 19, 2023, June 20, 2023 and July 31, 2023. 

However, EPRA rejected all three applications at every instance for not meeting the set criteria.

In March 2020 and January 2021, the plant was illegally constructed at the said location but was demolished by EPRA and the operators charged in court.

"Preliminary findings indicate that on the fateful night, the refilling of LPG cylinders was done using direct manifold connections to the LPG tanker increasing the risk of leakage and explosion," the duo stated.

"We wish quick recovery to the injured and send sincere condolences to those who have lost their loved ones," they stated.

EPRA Explains Why It Rejected Licence for Embakasi Gas Plant

The Energy and Petroleum Regulatory Authority (EPRA) has denied granting a licence to the gas filling plant at the centre of the explosion incident at the Mradi area in Embakasi on Thursday night. 

In a statement, EPRA explained that it rejected three applications for construction permits as the owners did not meet the criteria for managing a Liquefied Petroleum Gas (LPG) plant. 

According to EPRA, the proposal was rejected due to its proximity to residential areas, which violated its regulations.

"Applications for construction permits for a Liquefied Petroleum Gas (LPG) storage and filling plant at the site were received by EPRA on March 19, 2023, June 20, 2023, and July 31, 2023. All applications were rejected as they did not meet the set criteria for an LPG storage and filling plant in that area," the statement read in part.

"The main reason for the rejection was the failure of the designs to meet the safety distances stipulated in the Kenya Standard."

Further, the Authority requested the owners to submit a Qualitative Risk Assessment, outlining the radiation blast profiles if an explosion occurs. 

The blast profiles are simulated using computer software and indicate the effect of a typical blast in terms of heat radiation and tremor/vibration and are useful in reviewing the safety of the surrounding areas.

EPRA explained that the LPG plant did not adhere to the guidelines as it never provided the requested QRA. 

While detailing the necessary actions, EPRA pointed out that it had formulated short and medium-term measures to ensure the safety of all LPG plants in the country. 

"This is through actions such as undertaking detailed technical audits of all licensed LPG plants in the country to ensure high safety integrity status in terms of Health, Safety, Security and Environment (HSSE)."

EPRA highlighted that administration actions are always taken to ensure operating licences for all plants rated below the high safety integrity status are revoked. 

"In addition, surveillance and enforcement actions are taken including demolishing illegal plants operating across the country and curbing malpractice in the sector."

The explosion in Embakasi has gained nationwide attention after the incident claimed three lives and 270 casualties. Following the incident, the public questioned why the gas filling plant was operational despite being close to residential areas.

Police have arrested a watchman linked to the Embakasi gas explosion that has so far claimed three lives and injured over 220 others. 

DCI detectives made the arrests minutes after they were given 48 hours to investigate the case. 

Police stated that the watchman was in charge of guarding the premises where the lorry loaded with gas that exploded was stationed. However, DCI has yet to state the charges preferred against the watchman whose identity is still unknown. 

Reports further indicated that two mechanics were also linked to the case, with residents alleging that they caused the fire that led to the explosion.

The embattled residents claimed that they detected the scent of leaking gas at around 10 pm, while the mechanics were repairing a car that had broken down in the vicinity. 

Alarmed by the leaking gas, they allegedly warned the mechanics against jump-starting the car as the sparks would have caused a fire. 

It is yet to be clear whether the mechanics were the sole cause of the fire as alleged as DCI detectives are yet to trace their whereabouts. 

The inferno was reported on Thursday night after a gas explosion occurred near a residential area in Embakasi. 

Some residents faulted the National Environment Management Authority (NEMA), noting that concerns raised to the authority regarding the gas facility polluting the air in the area were ignored. 

"You can imagine the last two months I lived in that house, I didn't step onto my balcony or even open the windows of my house. I couldn’t handle the smell of the gas anymore," a real estate specialist living in the area stated. 

Hundreds of victims were rushed to Mama Lucy Hospital and Kenyatta National Hospital (KNH) for medical treatment. Government Spokesperson Isaac Mwaura later urged members of the public to keep off the area to allow the rescue mission and investigations to be carried out smoothly. 

Nairobi Women representative Esther Passaris, responding to the tragedy, further vowed to help the affected and rallied wellwishers to donate blood at various hospitals. 

Governor Johnson Sakaja has also promised that Nairobi County will waive all medical fees for the Embakasi fire victims, as the distribution of relief items to help those affected kicks off.
