It's Illegal & Unconstitutional – LSK Declares as Kenya Gears to Deploy Police to Haiti

Faith Odhiambo, the President of the Law Society of Kenya (LSK) on Sunday weighed in on the looming deployment of 1,000 police officers to Haiti.

In a statement, Odhiambo accused the government of failing to adhere to court orders as delivered on January 26.

She explained that despite the two countries forming a bilateral treaty to guide the deployment, there are a few legal requirements which have not been met.

Odhiambo went on to term the deployment as "unconstitutional and illegal". She urged President William Ruto to adhere to the court ruling before the deployment scheduled for the end of May.

"We remind the President that he took Oath of Office to protect the Constitution and has several occasions reiterated that his government would comply with the rule of law."

"Therefore, we urge the President in the same regard to obey court orders, as this is the grind upon which this country strives to ensure accountability and transparency," she added.

According to Odhiambo, the High Court in January ruled that sections 107, 108 and 109 of the National Police Service Act must be complied with when the deployment is done.

Additionally, the lawyer elaborated that this Act mandates that Haiti must be gazetted as a reciprocating country and that its municipal law has provisions similar to Kenya's NPS Act.

She remarked that LSK had condemned the disregard for the rule of law being demonstrated by the President and government agencies involved in the deployment.

"The Law Society of Kenya stands at the forefront of upholding the principles of justice, accountability and the rule of law within our nation," she emphasised.

This came a few moments after Foreign Cabinet Secretary Korir Sing'oei emphasised that the deployment would be done over the next few weeks.

Sing'oei addressing journalists at Harambee House on Sunday revealed that Kenya is in preparation mode to facilitate the deployment despite the numerous challenges that the government had encountered.

He also dismissed reports that President Ruto would stop over Port au Prince during his State visit to the USA that starts on May 20 to May 24.

The deployment is expected to coincide with Ruto's visit. Kenya will be leading the Multinational Security Support mission regardless of the recent case filed by lawyer Ekuru Aukot.
