Communications Authority Denies Sharing Location Data in Albert Ojwang's Arrest

The Communications Authority of Kenya (CA) has clarified allegations that it helped law enforcers track down the late Albert Ojwang.

In a statement released on Wednesday, June 11, the Authority denied the claims circulating on social media, stating that the allegations are misleading.

CA affirmed that it did not provide any data and distanced itself from any involvement in the case.

"We note with grave concern the misleading claims on social media platforms alleging the CA provided data on the whereabouts of the deceased to law enforcement.

"This position is factually erroneous. We categorically distance CA from any involvement whatsoever on this matter," the statement reads.

The Authority stated that it has no access to the live location data of mobile phone users, nor does it collect or share personal data from mobile service providers.

According to the CAK, if the police require any data, they must go through legal channels via court orders or an official request under the law.

"Any request for data from the law enforcement agencies is governed by strict legal provisions that include judicial oversight and is limited to instances where there is a valid court order or lawful request by the law," part of the statement reads.

CAK stated that it operates under the Kenya Information and Communications Act, 1998, and its mandate is to support the development of services such as broadcasting, telecommunications, cybersecurity, and internet use in Kenya.

The Authority, however, clarified that it ensures companies in the communications sector comply with laws and regulations, and does not monitor individuals.

It urged media outlets and social media platforms to verify information before sharing it, to prevent public confusion.

This comes after the public raised concerns about how police officers tracked Ojwang's whereabouts.

Ojwang, who was in custody over a defamation allegation at Central Police Station, was found dead on Sunday, 8 June.
