Three activists who were arrested on suspicion of fueling the violence during the Wednesday, June 25, protests have been granted a cash bail of Ksh200,000 a week after the arrests.
Speaking on Wednesday, July 2, their lawyer revealed that the three, John Mulingwa Nzau, Mark Amiani and Mutunge Mwangi, would be released within the day.
However, they have also been issued several conditions by the magistrate, including desisting from activities that landed them in jail, a condition that the lawyer admitted might be tough, as they are human rights activists.
"I do not know how they will desist because a human rights defender is a human rights defender," he stated.
"She (the magistrate) also told them to report to the station every Monday and Thursday of the week. Cash bail is set at Ksh200,000. We are struggling to get this cash bail, but we are hopeful they will be released today."
The next mention of the case will be held on July 23.
The three were arrested on June 26 after being accused of being the masterminds who organised the infiltration of goons in the June 25 commemorative protests.
In its report, the DCI claimed that the three had used coordinated channels and social media posts to incite goons to violence, massive theft and destruction of property during the protests.
They were arrested off a Mombasa-bound bus at the Konza City section, eliciting a public uproar as they were soon identified as activists.
Among those who decried the arrests was the Kenya Human Rights Commission (KHRC), which termed the arrests as a blatant effort to criminalise dissent.
"These charges are not only baseless, but they also represent a deliberate distortion of the truth," part of the statement read.
"The three comrades are well-known human rights defenders regionally recognised for their integration of music and art into movement building as well as consistent solidarity with the oppressed as key pillars of their organising."
