Court Directs DPP to Consult EACC Over Plea to Withdraw Okoth Obado’s Ksh505 Million Graft Case

The Anti-Corruption Court has directed Director of Public Prosecution(DPP) Renson Igonga to consult with Ethics and Anti-Corruption Commission(EACC) within 14 days regarding the plea to withdraw former Migori Governor Okoth Obado’s Ksh505 million graft case.

Anti-Corruption Court stated that the matter will be mentioned on November 7, 2025, after receiving the consultation report from both offices.

The court’s decision came a month after Igonga, on September 1, sought to withdraw the corruption charges against Obado through a plea bargain agreement.

The DPP told the court that his office had already entered into the deal with the former governor.

EACC, however, clarified that it had not signed the agreement, raising questions about whether the deal had full approval from all investigating agencies involved in the case.

EACC and ODPP had earlier jointly asked court for a one-month adjournment to finalize the ongoing negotiations.

The agencies informed the court that the discussions were at a stage and were aimed at reaching an out of court settlement through a plea bargain.

Initially, the EACC had sought to recover over Ksh1.9 billion from Obado and more than 20 other individuals accused of siphoning funds from the Migori County government through fictitious procurement contracts.

Obado has been in court for over four years and has been facing charges of abuse of office, conspiracy to commit an economic crime, money laundering, and unlawful acquisition of public property.

He was also accused of misappropriating amounts estimated at Ksh73 million during his tenure as the county boss.

Obado, together with 10 others, was first arrested in August 2020 after the ODPP accused them of using 13 companies to siphon money from the Migori County government.

Among those arrested and facing charges are four of the governor's children, believed to have received payments from companies that traded with the County Government of Migori between 2013 and 2017.
