LSK Takes Action After 17-Year-Old Boy is Abused in Custody, Jailed Without Legal Representation

Law Society of Kenya (LSK) has stepped in to seek justice for a 17-year-old Form Two student who is currently receiving treatment after he was allegedly assaulted by police officers while in custody.

According to LSK President Faith Odhiambo, the boy is currently receiving treatment at the Narok County Referral Hospital under police custody.

Odhiambo also revealed that she has appointed an advocate to pursue all legal options to ensure the boy receives justice and that those responsible for his mistreatment are held accountable.

“This unfortunate situation undermines the best interests of the Child and is inconsistent with the Constitution. We have instructed an advocate to pursue all legal avenues to ensure the boy gets justice and hold all those responsible for this grave miscarriage of justice accountable,” she said.

The boy was arrested on October 10, 2025, and arraigned on October 13 where he was charged with allegedly breaking into a building and committing a felony.

After visiting him in the hospital, Odhiambo confirmed that the boy sustained severe injuries allegedly caused by physical abuse while in police custody. 

He informed Odhiambo that one of the individuals who assaulted him was present during his court appearance.

According to the LSK President, the boy was denied legal representation during his trial and his parents or guardians were not present during the plea taking.

Despite the boy’s age, Narok Magistrate’s Court reportedly proceeded to sentence him, disregarding laws meant to protect minors.

Assault in Police Custody

Earlier, the family claimed that the boy was assaulted while in police custody after refusing to confess to the alleged theft. 

They further alleged that the officers denied them access to visit him after his arrest, only learning of his condition after he was taken to the hospital.

The doctors attending to the teenager at Narok County Referral Hospital described his condition as critical. 

They revealed that he had severe infections in both legs, indicating a possible chemical burns.
