Nandi Senator Samson Cherargei has called for legal action against John Cox, the Registrar of Political Parties, for 'illegally' approving the registration of political parties.
The lawmaker, on Wednesday, December 10, took issue with the approval of former Nairobi Governor Mike Sonko's new political party, which was approved by the Office of the Registrar of Political Parties (ORPP) just a day earlier.
Cherargei argued that allowing the former governor to lead a political party is unconstitutional given that he has been impeached.
Despite the constitution guaranteeing political freedom in the country, Cherargei clarified that Sonko, former Deputy President Rigathi Gachagua, and former Kiambu Governor Ferdinand Waititu have no right to lead political parties since they were impeached.
The senator alleged that the registrar of political parties has contravened the chapter on leadership and integrity and should be held accountable.
"Sonko, Waititu and Gachagua are impeached and therefore do not have locus standi to form or run political parties in Kenya despite the constitutional provision of political freedoms," Cheragei said.
"The fact that the registrar of political parties (RPP) approved party officials who are impeached are allowed to form & run political Parties is a puzzle, illegal, unconstitutional, and corruption of the highest order," he added.
Waititu is apparently the current leader of the Farmers Party, having taken over in February 2025. Gachagua is said to be the leader of the Democracy for the Citizens Party (DCP), which he launched in May 2025.
Meanwhile, Sonko received a certificate of registration for his new National Economic Development Party (NEDP) from the ORPP on Tuesday, December 10.
He is expected to use the party to revive his political career in the highly anticipated 2027 general elections.
The ORPP's approval of Sonko's party indicates that it has met all the legal and administrative criteria outlined in the Political Parties Act.
According to reports, the former Nairobi boss is expected to be formally installed as the official party leader in early 2026.
"The National Economic Development Party of Kenya (NEDP) is now fully authorised to field candidates for any elective position in any by-election across the country," Sonko said in his social media accounts after receiving the certificate.
