Presidential aspirant Peter Solomon Gichira has made a second attempt at acquiring the Independent Electoral and Boundaries Commission (IEBC) clearance to vie in the August 8 General Election.
Mr Gichira made an urgent application to the courts seeking to have the IEBC compelled to reconsider his application.
In his submission to the court, he noted that the electoral body had defied an earlier court order that had directed Chairman Wafula Chebukati to allow him to resubmit his papers.
He added that the body was deliberately trying to dash his expectations citing that he had raised his hopes after the High Court rubbished the requirement for 2,000 signatures.
"I find the requirement does not meet the fairness and reasonability test as provided for under Article 24 of the Constitution," Justice George Odunga ruled.
Gichira conveyed that the tussle was causing tension in his campaign team as they feared he may be blocked from vying.
"There is real apprehension that the IEBC will print ballot papers for the presidential election and completely lock me out from contesting," Gichira protested.
The aspirant was arrested last week for allegedly attempting suicide by jumping off the sixth floor of IEBC offices, after the commission told him he would not be cleared to present his papers and run as an independent candidate for the presidential seat.

He was arraigned at the Milimani Law Courts earlier this week where he denied the charges and was released on a Sh200,000 cash bail.
