Wamunyu MCA Kyalo Kyuli Appeals High Court's Decision to Clear Wavinya Ndeti for Machakos Governor Race

A Machakos Member of County Assembly (MCA) has moved to the Court of Appeal to challenge a decision to clear gubernatorial aspirant Wavinya Ndeti.

Wamunyu MCA Kyalo Kyuli filed the appeal hours after High Court's Justice George Odunga ruled that Ms Ndeti was eligible to vie for the Machakos seat.

On Wednesday morning, the Court nullified an earlier ruling by the IEBC Disputes Committee which barred Ms Ndeti from the Machakos race for allegedly being a member of member of Chama Cha Uzalendo (CCU) Party and the Wiper Party.

In his ruling, Odunga argued the Political Parties Disputes Tribunal had already decided that she was a member of Wiper stating that the IEBC committee had no power to nullify the Parties Tribunal's decision.

Following the decision, Ndeti's supporters broke into song and dance blasting the IEBC for trying to bar the former Kathiani Member of Parliament from the race.

MCA Kyuli had initially filed a petition with the IEBC claiming that the governorship aspirant had resigned from CCU a day after the deadline for party hopping.

In his submission, the MCA argued that documents from the Registrar of Political Parties indicated Ms Ndeti joined Wiper on April 6 despite the decamping deadline being April 5.
