High Court Postpones Ballot Papers Printing Tender Case to Friday

The High Court has directed that a case challenging the award of ballot papers printing tender to Dubai-based Al Ghurair firm be postponed to Friday.

The three-judge bench comprising of Justice George Odunga, Joel Ngugi and John Mativo gave the ruling during the start of the case filed by the National Super Alliance (NASA).

This followed an application by NASA lawyer James Orengo who requested for more time for his team to make its submissions.

NASA sued the Independent Electoral and Boundaries Commission (IEBC) seeking the cancellation of ballot printing tender after raising concerns that Al Ghurair had links with the Jubilee government.

Giving the ruling, the court ordered that the applicants file their submission by Wednesday midday and the respondents do the same by Thursday midnight.

The Opposition was further directed to serve the IEBC which is being represented by lawyer Fred Ngatia in good time.

The judges advised that the documents should not exceed 20 pages in order for the case to be heard and determined possibly by next week, due to the urgency of the matter.

On Friday, Odunga failed to suspend the printing of the papers which started the same but recommended that the case is heard by a three-judge bench.

Chief Justice David Maraga appointed the three judges to determine the matter.
