IEBC Announces Plan to Adjust Voting Hours in Lamu, Garissa and Tana River

The Independent Electoral and Boundaries Commission (IEBC) has announced that voting hours in Lamu, Garissa and Tana River counties will be subject to adjustments.

Speaking in court on Wednesday, the commission stated that the adjustments had been made following the dusk to dawn curfew imposed by the acting Interior Cabinet Secretary, Fred Matiang'i.

National Super Alliance (NASA) moved to court in July to challenge Dr Matiangi's decision to impose the curfew alleging that it was a plan to rig the elections.  

During the court proceedings, NASA stated that the effect of the curfew would be limited voting time and delay in the start of the exercise on the voting day.

"As a result of the curfew, the petitioner is apprehensive that the curfew shall result in the infringement of its political rights and those of citizens of the counties," NASA lawyers argued.

Quoting rule 64(1) of the Election Regulations, IEBC noted that presiding officers are empowered to adjourn and extend proceedings in polling stations where voting has been interrupted, or for any other valid cause.

"Any delay in the opening of polls in the affected areas will be compensated by exercise of the provisions of rule 64(1) and 64 (3) of the Election General regulations," the IEBC stated.

The elections body further defended its position saying that the new regulations adhered to its constitutional mandate.

They assured the court that they would ensure a free and fair election in the entire country and more specifically the three counties where curfew have been imposed.
