Embu Governor Governor Martin Wambora Loses First Round of Petition Filed by Lenny Kivuti

Embu Governor Martin Wambora has lost to former Embu Senator Lenny Kivuti in the first round of a hearing of a petition challenging his (Wambora) win in the August election.

In the petition filed at the Embu High Court, Mr Kivuti sought the protection of ballot papers and results' entry forms used in the management of the governor elections.

Ruling in Kivuti's favour, the High Court ordered the providence of all the election materials in the next hearing to ascertain whether there was malpractice the Embu gubernatorial election.

Justice Florence Muchemi made the directive emphasizing that electronic kits and other materials used in the disputed election be provided to the court by the Independent Electoral and Boundaries Commission (IEBC).

“The orders should remain in force pending the hearing and determination of this case, which will be heard on September 20,” Justice Muchemi stated.

Among the election materials required during the next hearing include counted ballot papers and rejected ones, ballot boxes, written statements by presiding officers, printed copies of the register used and the copies of the results of each polling station.

The materials required are those of the polling stations on which Mr Kivutu raised queries which include Manyatta, Runyenjes and Mbeere South Constituencies.

This petition comes days after the Embu Governor was sworn in after beating Mr Kivuti in the poll with a margin of 932 votes.

Nonetheless, the outgoing senator stated that he won the seat by more than 453 votes, adding that the declared votes at the polling centers were not the ones that were entered into the entry forms.

Wambora's legal team comprises of lawyers Tom Ojienda, Mr Wilfred Nyamu, Mr Baniel Kamunda and Mr Kirimi Guantai.
