Senator James Orengo and 9 Other NASA Lawyers Move Back to Court in New Petition

Siaya Senator James Orengo, Rarieda Member of Parliament Otiende Amollo and eight other National Super Alliance (NASA) lawyers have reportedly moved to court in a new petition challenging the re-election of  Machakos Governor Alfred Mutua.

Lawyer Dan Maanzo, who is also Makueni MP, on Tuesday told journalists that the petitioner, Wavinya Ndeti, had at least 10 lawyers who will argue her case against Governor Mutua.

"Senior Counsel Otiende Amollo will lead a pack of nine other legal minds that will be representing Wavinya in this case," he stated.

On Tuesday, Ms Ndeti filed her petition of more than 10,000 pages at the Machakos law courts shortly after 6 pm.

In her petition, Ndeti alleges that Mutua's win was preceded by massive irregularities. She alleged that there was massive rigging which led to the failure to sign forms 37A, 37B, and 37C, as required by law.

Just like Form 34A, 34B and 34 C are used in the declaration of the Presidential elections, forms 37A, 37B, and 37C are used in the declaration of Gubernatorial elections. 

The former MP also claims that there were non-existent polling centres.

Ms Ndeti noted that just like the Supreme Court had nullified the Presidential election, she expected the same to apply in her case.

Lawyer Maanzo on his part stated that they had enough evidence to back their case, adding that they would be seeking a nullification of the election, which was marred by irregularities.

"We have water-tight evidence to demonstrate Mutua did not win the election in a free, fair, and transparent manner, as demanded by law.

“We are seeking several orders so that the election can be nullified. We cannot have peace without justice and so we have come to court to seek justice, Maanzo stated.

In last month's elections, Governor Mutua was declared the winner after garnering 249,954 votes against Ndeti's 209,233.

Ms Ndeti now joins a long list of politicians who have challenged the results. Other petitioners disputing results include; Martha Karua, Farah Maalim, Hassan Noor Haasan and many others.
