Raila Odinga Explains Why President Uhuru Kenyatta Cannot Impeach Him

Opposition Leader Raila Odinga on Tuesday expressed confidence that President Uhuru Kenyatta cannot kick him out of office if he (Raila) is elected in the October 17 election.

Speaking during an interview with KTN News, Mr Odinga noted that the impeachment threat by President Kenyatta was just an illusion since the law clearly outlines how a Head of State would be impeached.

The former Prime Minister explained that to impeach the President, one must bring a motion to the National Assembly and get an absolute two-thirds majority support from the legislators.

After that, the petitioner will be required to formulate a charge which would then be taken to the Senate for a hearing after which the House will require an absolute majority to kick out the President.

"You just don't impeach a President because he is not from your party unless he has committed something very serious," Odinga stated.

According to Odinga, Jubilee lacks the required absolute majority and as such, they cannot impeach him if he is elected President in October.

He further noted that there will be no cause for him to be impeached since for one to be kicked out he must have committed "a serious mistake."

To clinch a two-thirds majority, this would require support from 237 MPs. According to President Kenyatta, his party is only 13 members short of attaining this requisite number that would even allow Jubilee to amend the Constitution.

According to the Constitution, the President can be impeached under the following circumstances;

1. On the ground of a gross violation of a provision of the Constitution or of any other law.

2. Where there are serious reasons for believing that the President has committed a crime under national or international law.

3. For gross misconduct.

On Monday, President Kenyatta touted that Jubilee had the numbers in both Houses and if Mr Odinga is elected in October, they would impeach him.

"Even if he is elected we will remove him within two months. We have the numbers. Truth should be told," President Kenyatta stated.
