Two men and a woman have been arrested in Machakos after they were found in possession of ballot papers.
The three have been identified as Cecilia Kimeu, Boniface Nzioka and Stephen Omondi who were found with the ballot papers in Athi River town.
The case was brought before the court on Thursday, however, the accused did not take a plea in the matter as Senior Resident Magistrate Kipkurui Kipkelion was not available to hear the case.
The case will be mentioned on Friday with the hearing date yet to be published.
The three were found with the election materials even as the IEBC is set to furnish the court with all ballots cast for the Machakos gubernatorial election on Friday.
Justice Aggrey Muchelule gave the order in a petition filed by former Kathiani MP Wavinya Ndeti challenging the re-election of Governor Alfred Mutua.
Ms Ndeti will be represented by Senior Counsel James Orengo along with lawyer Daniel Maanzo.
