High Court Makes Final Decision in Gladys Shollei’s Corruption Case

A Nairobi magistrate court has discharged former Chief Registrar Gladys Boss Shollei and six others of corruption charges.

Senior Principal Magistrate Felix Kombo on Monday allowed Director of Public Prosecutions (DPP) Keriako Tobiko to withdrawal of the case under Section 87a of the Criminal Procedure Code.

This comes after the office of the DPP sought to withdraw the matter under section 87(a) of the CPC.

The DPP argued that by the time they were being investigated and charged, the Ethics and Anti-Corruption Commission (EACC) was not properly constituted.

The other suspects include former deputy chief registrar Kakai Kissinger, Martin Otieno Okwata (former Director of Supply Chain Management), Benedict Abonyo Omollo (former Director of Finance) and tender committee members Wycliffe Wanga Ombunde, Nicholas Muturi Okemwa, Nicholas Mbeba and Thomas Oloo Atak.

They were accused of irregular purchase of a house worth Sh310 Million for former Chief justice Willy Mutunga.

The house in Nairobi's Runda estate is said to have been purchased from former Machakos Senator Johnstone Muthama without following procurement procedures.

The suspects were charged with three counts of engaging in a project without prior planning and failing to comply with procurement procedures.

They, however, denied the charges and were released on a cash bail of Sh600,000 each with an alternative of a Sh1.5 Million bond and one surety. 

Later, Ms Shollei was sacked from her position as Chief Registrar of Supreme Court over allegations that she misused Sh2.2 Billion.
