IEBC Official Lands in Court Over Uhuru's Votes

An IEBC Presiding Officer (PO) was on Tuesday charged for wrongfully awarding President Uhuru Kenyatta's votes to Independent Presidential Candidate Japtheth Kaluyu.

Kiiri polling station PO John Kiguru was charged with the offence of making an entry contrary to the Elections Act where he awarded Prof Kaluyu 440 votes garnered by President Kenyatta. 

The PO was, however, not able to take a plea as the Senior Resident Magistrate Manuela Kinyanjui referred the matter to Murang'a court.

Mr Kinyanjui noted that he transferred the case since it involved an electoral offence and the court had no jurisdiction over such matters.

"The file will be transferred to Murang'a law court, where there is an electoral court, for plea-taking and trial," the Magistrate stated.

The Presiding Officer was arrested on Monday after the Commission complained regarding the anomalies. 

Mr Kiguru's error on the electoral form raised a lot of debate in the constituency with the Returning Officer Martin Malonza and Jubilee chief agent MP Alice Wahome engaging in a scuffle.

In a video that emerged online, Ms Wahome is seen shouting at Mr Malonza over the election results.

On Sunday, the IEBC official stated that the legislator was out of line assaulting him while performing his duties.

"She harassed and abused me, calling me all manner of things, saying I'm stupid but I had to do my job which I am committed to doing

"She took my coat which had money in it which I don't know where it is until today. It had Sh14,000. I don't know where she took it," he stated.

Ms Wahome, while speaking to Kenyans.co.ke, refuted allegations by the RO insisting that she did not harass Mr Malonza but only wanted to check on the results that he had indicated.

“I did not harass him, that is not harassment. I was merely checking on the results to verify what had been recorded for the Jubilee candidate. I asked him calmly then he started shouting at me, who does that? " she stated.
