IEBC Ordered to Repeat Vote Tallying

The High Court has asked the Independent Electoral and Boundaries Commission (IEBC) to recount votes cast in every polling station in Homa Bay County.

Justice Joseph Karanja ordered IEBC to seal and secure all ballot boxes containing the votes cast in the election.

The judge also ordered the electoral commission to study all forms 37A, 37B and 37C used to declare the winner.

He further ordered the scrutiny and an audit of the Kenya Integrated Management Systems (KIEMS) and any other technology deployed during the election.

IEBC, through lawyer Fredrick Orego, promised to cooperate with the court to ensure that justice prevails.

The orders were given after former Kasipul MP Oyugi Magwanga filed a petition challenging Homa Bay Governor Cyprian Awiti's election.

Magwanga who lost his bid in the gubernatorial race sued IEBC, Awiti, his deputy Hamilton Orata and Homa Bay Returning Officer Michael Kosgei.

In his affidavit, the petitioner asked the court to declare Awiti's election null and void.

Magwanga further requested the court to declare him the validly elected Governor alongside his running mate Joshua Orero.

Awiti who was vying on an Orange Democratic Movement (ODM) ticket garnered  210,173 votes against Magwanga's 189,016 votes.
