New Details Emerge on Supreme Court Petition Against Uhuru

New details have emerged indicating the specific prayers petitioners Njonjo Mue and Khelef Khalifa are seeking in a case challenging the re-election of President Uhuru Kenyatta.

The two, in their petition filed on Monday, want the Supreme Court to order a scrutiny of all electoral forms and kits used in the October 26th poll.

The petitioner specifically wants the court to direct for an examination of Form 34As, 34Bs and 34Cs used to declare Kenyatta as the President-elect.

“An order for scrutiny and audit of all the returns of the presidential election including but not limited to forms 34A, 34B and 34C," the petition reads in part.

Forms 34A, 34B and 34C are the documents used in the declaration of the Presidential results where 34A represents information from the polling station, 34B has results from the Constituency and 34C represents information from the National Returning Officer.

The applicant also wants the court to scrutinise the polling diaries and forms 32As used during the repeat election.

Form 32A is the document that the Commission used to record situations where a voter had been identified using the manual register as opposed to the digital kits.

Mr Mue and Khalifa filed their petition on Monday arguing that the fresh poll was not held in strict conformity with the Constitution, the applicable laws, and as directed by the Supreme Court.

They want the Court to declare President Kenyatta's re-election null and void.

In the case, the petitioners have also taken issue with IEBC for "failing to conduct any nominations of presidential candidates prior to gazetting the names of the eight contenders."
