Supreme Court Dismisses Case Against Raila

The Supreme Court has dismissed two petitions that were filed by a lobby group and a Jubilee Party MP seeking to have National Super Alliance (NASA) leader Raila Odinga charged with treason.

The Institute of Democratic Governance and Pokot South MP David Pkosing had filed petitions against NASA principals led by Odinga.

They wanted Mr Odinga to be held liable for impeding the electoral process, causing violence and destruction of property.

Chief Justice David Maraga stated that the issues raised would divert their focus away from crucial petitions that needed to be heard immediately.

He stated: "The matter does not fall under the purview of presidential petitions.

"If this court loses focus and succumbs to pressure to allow all petitions, it will not be able to determine them within stipulated timelines. We decline to grant the prayers but the matter will be heard after the determination of the two petitions before us," he continued.

The case will, therefore, be heard once two petitions challenging the validity of the October 26 repeat election have been decided.

Prior to the poll, Pkosing had claimed that the former Prime Minister had an elaborate plan in place to scuttle the entire election.

He alleged that NASA was determined to force a constitutional crisis.

According to Pkosing, this was meant to allow them to negotiate a power-sharing agreement.
