Results From 170 Polling Stations Were Fake - IT Expert Exposes

An expert witness has refuted the authenticity of parliamentary seat results from 170 polling stations out of the 187 stations in Kitutu Masaba constituency deeming them as fake.

Dr Noah Akora, an IT expert, told the Nyamira High Court that the voting logs from the Kenya Integrated Election Management System (KIEMS) kits did not reflect the results.

"This means that 84,442 votes from those polling stations cannot be accounted for and the returning officer who declared the winner for the parliamentary seat got results from elsewhere.

"I was able to access logs for 40,833 polling stations across the country that were used during August 8 general elections," the witness explained.

Dr Akora added that the transmitted scanned images of forms 35A and forms 35B for Kitutu Masaba parliamentary seat were not reflected in the FTP (file transfer protocol) an oversight he termed "strange".

The IT expert is a witness in an election petition by a voter, Mr Justus Omiti, who is challenging MP Shadrack Mose's election during the August 8 election.

Lawyers representing the MP, Paul Lelan and William Mogaka, asked Judge Aaron Makau to dismiss the witness' statement contesting that Dr Akora's statement had not been filed with the court prior to the proceedings.

Earlier, the Independent Electoral and Boundaries Commission (IEBC) had admitted to wrongfully announcing inaccurate figures for Nyamira Governorship race during the August 8 election.

In addition, the electoral body confessed that John Nyagarama was announced the winner based on 37A, 37B and 37C that were submitted incorrectly.

In their defence, lawyer Jackson Nyamweya argued that the errors were not intentional and affected all the candidates.
