Wavinya Ndeti Embarrassed by Her Lawyer in Court

Former Machakos gubernatorial candidate Wavinya Ndeti was on Tuesday embarrassed in court after her lawyer disowned sworn affidavits by her witnesses.

Ms Ndeti had attended a court hearing on her petition challenging Governor Alfred Mutua's win in the August 8 election.

In a letter to presiding Judge Aggrey Muchelule, lawyer Ham Lang'at absolved himself from the witness accounts submitted by the former Kathiani Member of Parliment (MP).

Mr Lang'at strongly refuted that he had commissioned the affidavits to be submitted to the court.

The gubernatorial candidate who vied on a Wiper party ticket moved to court in September claiming to have evidence that proved Independent Electoral and Boundaries Commission (IEBC) irregularly declared Dr Mutua the winner.

IEBC Returning Officer Joyce Wamalwa declared the second-term Governor the winner after he managed to get 249, 954 votes against Ndeti's 209, 233.

The case seemed to gravitate in her favour after the High Court Judge gave her the first win by granting her application to have the IEBC present all election materials used on August 8 for the governor's contest.

Governor Mutua's lawyers stormed out of the court proceedings after Justice Muchelule declined to grant them a recess to review new evidence that had been presented to the court.

Dr Mutua was forced to request an adjournment to put together a new legal team to represent him.

The two rivals furthered their feud during the vetting of Governor Mutua's county executive committee members where Ms Ndeti is accused of having persuaded an employee of Makueni County, Meshak Musyoki, to engage a lawyer to prepare a falsified affidavit against the county executive nominees.
