Larry Madowo Summoned By DCI

NTV news anchor Larry Madowo was on Tuesday summoned by the Director of Criminal Investigations (DCI) to record a statement over an interview he conducted with opposition Chief Strategist David Ndii.

In a letter seen by Kenyans.co.ke, the DCI asked Nation Media group to avail Larry who interviewed Dr Ndii on August 22 on his popular late night show Side Bar.

The DCI boss stated that he wanted the journalist to help to investigate Dr Ndii for utterances which were meant to incite and cause violence which is against the law.

“This office is investigating a case of incitement to violence and subversive activities contrary to the penal code,” read the letter in part.

“To facilitate our investigations, please avail the news anchor, the interviewer in the above matter to come assist on the investigation and henceforth record a statement,” the letter stated.

However, Larry stated that his employer-Nation Media Group would state their position on him appearing before the DCI on Tuesday night.

“DCI wants me to record a statement about my interview with David Ndii. For our position on this, watch,” Larry stated.

The media house has since termed the request by the DCI as unethical maintaining that "neither Larry Madowo nor NTV will record a statement".

Section 96 of the Penal Code states that any person who threatens to bring death or physical injury, to lead to destruction of property, to prevent or defeat by violence the execution or enforcement of any written law or to lead to defiance of such laws or any lawful authority is guilty of an offence and is liable to imprisonment for a term not exceeding five years.

On the other hand, section 77 (1) states: "Any person who does or attempts to do, or makes any preparations to do, or conspires with any person to do, any act with  subversive intention, or utters any words with a subversive intention, is guilty of an offence and is liable to imprisonment for a term not exceeding seven years."

Dr Ndii was released on a Sh10,000 police bond after the Director of Public Prosecutions Keriako Tobiko ordered the DCI to release him on police bond.

Tobiko asked the police to complete their investigations and forward the inquiry file to him ‘for appropriate instructions’.

Dr Ndii was arrested by seven police officers from the Flying Squad and the Special Crimes Prevention Unit, at the Coast on Sunday evening.
