Senator Mithuka Linturi Excluded From UoN Graduation List

High Court Judge, George Odunga has denied a request by Meru Senator Mithuka Linturi to compel the University of Nairobi (UoN) to include him on the graduation list for a ceremony to be held on Friday.

Justice Odunga on Wednesday issued the ruling stating that the Senator had failed to demonstrate that his reputation will be damaged if he did not graduate.

Senator Linturi had moved to court to challenge the decision by the UoN Senate to de-register his Bachelor of Law degree on November 30.

The University's administration claimed that Mr Linturi had gained admission to the college using fake papers from Dr Babasaheb Ambedkar Marathwada University.

The Jubilee party politician dismissed the claims accusing the UoN senate of violating Article 47 of the Constitution by investigating him without prior written notice.

Mr Linturi told the court that he "learnt with shock" that he had been deregistered as a UoN student through the media.

He further claimed that the hitch was instigated by his political opponents Mugambi Imanyara and former Meru Governor Peter Munya.

Mr Linturi bundled up the Ethics and Anti-Corruption Commission (EACC) in his accusations outlining that they seem to have sided with his political rivals.

Justice Odunga urged the concerned parties to expedite the court proceedings as he adjourned the hearings of the day.

The case will be heard again on February 20, 2018.
