A petition was on Wednesday filed at the Judicial Service Commission (JSC) to have High Court Judge John Mativo removed from office over alleged gross misconduct.
The petitioner, Adrian Kamotho Njenga, claimed that Justice Mativo should be removed from office for allegedly violating some sections of the Judicial Code of Conduct.
According to the petitioner, Justice Mativo also defiled sections 73, 74, 75 of the Constitution which designates how state officers should conduct themselves.
Mr Njenga had on September 26, 2017, sought to review a judgment delivered by Justice Chacha Mwita on behalf of Justice Isaac Lenaola on February 24, 2017.

He alleged that the judge delivered a ruling that was “an outright copy paste” of another case determined by the Nyeri High Court on February 19, 2016.
“Justice John Mativo has failed to uphold the dignity and the respect for the judiciary and the judicial system of Kenya.
The plagiarism committed by the judge is the most scandalous form of judicial and intellectual dishonesty,” Mr Kamotho noted.
The petitioner remarked that his petition raised issues and faulted Justice Mativo for delivering his judgement on September 27, 2017, despite the ruling having been earmarked to be delivered on October 18, 2017.
He maintained that Justice Mativo failed to offer any explanation as to why the case was finalized in less than a day.

“Astonishingly, I was called a day later by a court assistant who informed me to go back the following day to pick the ruling,” Njenga maintained.
