Hassan Omar Withdraws Petition Against Mombasa Gov Joho

Former Mombasa Senator Hassan Omar on Tuesday applied to withdraw a case challenging the election of Governor Ali Hassan Joho.

In his application, he cited the alleged partiality of the judge, Justice Lydia Achode, who was hearing the election petition.

"The petitioner no longer has confidence on the neutrality of the presiding judge hearing and believes that he will not get justice in the matter," Mr Omar stated.

Mr Omar and his former running mate Linda Mariwa Shuma expressed their disbelief that they would not get justice in the matter.

"It will be hypocritical for the petitioners to proceed with this matter when they believe that the honorable court is already biased against them.

"It is in the interest of justice and within their legal right for them to be allowed to withdraw this petition," part of the application read.

The former Senator further requested the court to set a date for the hearing of the application.

In his application, he enjoined the Independent Electoral Boundaries Commission (IEBC), Returning officer Nancy Wanjiku Kariuki and Hassan Ali Joho as the respondents.

In his petition, he stated that there was massive tampering of election results in the county during the August polls.

He also mentioned that among the issues raised in his case was the abuse of public resources, use of state officers in campaigns and Governor Joho's academic qualifications.
