High Court Orders Government to Produce Miguna Miguna

  • High Court Judge Luka Kimaru ordered the Directorate of Criminal Investigations (DCI) and Inspector General Joseph Boinnet to produce Nairobi lawyer Miguna Miguna by 2 p.m. Monday afternoon.

    Issuing the urgent order, Justice Kimaru stated that the self-proclaimed General of the outlawed National Resistance Movement (NRM) should appear in his court, in the flesh.

    Justice Kimaru warned the Government institutions, including the Director of Public Prosecutions (DPP), that they would be held in contempt of court for a failure to adhere to the orders.

    He cautioned the institutions against such confrontations with the courts.

    When he was arrested on Friday, reports indicated that he had been booked at the Githunguri Police Station, however on Sunday, he was said to be at the Lari Police Station.

    He allegedly suffered an asthma attack while in custody with some reports indicating that he was denied medication.

    "It's true. We received info that Miguna has suffered an Asthma attack. I have with me an inhaler but the OCS has become hostile.

    "He won't let me see my client to give him the medication," lawyer Edwin Sifuna wrote on his Twitter handle.

    Speaking on Monday, lawyer Nelson Havi maintained that his client's medical condition had worsened due to the lack of medication.

    "We are concerned because Miguna is not in good health and police have refused him to access his doctor and lawyer," Mr Havi reiterated.

    The NRM General was arrested for his participation in the swearing-in of NASA leader Raila Odinga as the people's president.

    The ceremony held at the Uhuru Park grounds on January 30 has since been termed as an act of treason with Ruaraka MP Tom Kajwang' having been arrested and charged in court with similar accusations.
