The High Court has slapped flamboyant politician Steve Mbogo with a fine of Sh10 Million after losing an election petition.
In a ruling delivered on Monday, Justice Fred Ochieng upheld the election of Starehe Member of Parliament Charles Njagua alias Jaguar.
The judge maintained that there was lack of enough evidence after the court declined to grant Mbogo an order for scrutiny and recount of votes cast in his favour.
Justice Ochieng’ further dismissed Mbogo’s allegation that he had been assaulted by Jaguar saying there was no proof of the same.

He had earlier argued that it appeared Mbogo had asked for scrutiny because he hoped to use it to get more information, which could be useful in his petition.
“Scrutiny must never be a process through which a party can obtain new or further evidence. I find no merit in the application,” he earlier on noted.
The judge had also ruled that Mbogo failed to make a case for the provision of polling station diaries.
He maintained that the Independent Electoral and Boundaries Commission (IEBC) cannot be faulted for not making available all the polling station diaries.
Mbogo testified that after reviewing forms 34B and 35B and other results declaration forms used, he discovered that the results declared by IEBC had massive numeric discrepancies that affected the final results.

He had earlier on told the court that IEBC failed to conduct a free and fair election on August 8 and accused the Jubilee Party of rigging in its candidate.
