The Court has ruled in favour of Nandi Hills Member of Parliament Alfred Keter in a case against the gag by the Jubilee Party.
In a verdict delivered on Monday, the judge declared that Jubilee Party did not have the mandate to limit its lawmakers from airing their personal views.
Keter had filed the lawsuit alongside MPs Kangogo Bowen, Silas Tiren and James Gakuya who were ousted from house leadership.
The legislators were kicked out of their positions in parliamentary committees and blamed the Executive for orchestrating the move.

“In any event, no cogent and lawful reason has been given as to why a vote of no confidence would be sufficient against us other than the fact that the executive would prefer certain individuals over us,” they stated through their lawyer Frank Weluwe.
Keter on Sunday castigated Jubilee for dressing down its MPs and the manner in which they were handling the lawmakers.
Jubilee MPs have revealed that every decision relating to their work was being made at higher levels and passed down to them for rubber-stamping and implementation.
Reports by Daily Nation have alleged that Jubilee MPs have been getting dress-downs whenever they attend parliamentary group meetings at State House.
Additionally, another source told the local daily that the latest meeting by the legislators where a majority of the ruling party lawmakers failed to attend, was even more embarrassing.

The MPs were also gagged by the party leadership from attending live TV or radio interviews without consent from above.
