Judge’s 3 Mistakes That Could Send Apostle James Ng’ang’a to Jail – DPP

The Office of the Director of Public Prosecutions (ODPP) has identified three mistakes that made the ruling that acquitted Apostle James Ng’ang’a to be erroneous.

According to the DPP, Magistrate Godfrey Oduor failed to justify his May 4 ruling with the reasons for acquittal.

Second, the ODPP took issue with the fact that the case was heard by a different magistrate before Oduor gave the final ruling.

The court was further indicted for adjourning the case three times before it was heard and determined.

"This shall be brought to the attention of the High Court for an appropriate remedy," a statement from the ODPP read in part.

The public prosecutor further outlined that the charge brought against Apostle Ng’ang’a and his co-accused was intended to obstruct justice.

"All the accused faced the charge of conspiracy to defeat justice by misleading Investigating Officers in respect of Tigoni IAR (F) 44/2015 in order to defeat justice," the statement outlined.

Members of the public have taken interest in the case where the preacher was charged with the murder of Mercy Njeri after his Range Rover collided with a Nissan March she was travelling in with her husband.

Netizens initiated a hashtag #JusticeForMercyNjeri on Tuesday as Interior Cabinet Secretary Fred Matiang’i directed that the ODPP appeal the decision made at the Limuru Law Courts.

Ms Njeri's family had conveyed their disappointment that the court dismissed the case arguing that the four accused "had no case to answer".
