Former Transport CS Michael Kamau's Home Raided by EACC

Detectives from the Ethics and Anti-Corruption Commission (EACC)on Tuesday raided the home of former Transport Cabinet Secretary Michael Kamau in Nairobi.

Reports indicate that the officials from the EACC conducted the raid over a probe into a Ksh33 million road tender facing the former CS.

Family members of Eng. Kamau maintained that the EACC detectives did not have any search or arrest warrants during the raid which happened at 5:30 am.

Even with the lack of a search warrant, the detectives were allowed access to the home which is located at Windy Ridge, Karen.

Engineer Kamau had been charged with corruption and although the case was withdrawn, EACC had been allowed to begin fresh investigations into the accusations against former Transport CS.

High Court Judge Hedwig Ongudi declined to allow his application to be acquitted, stating that his appeal was allowed because EACC was not properly constituted at the time it completed the investigations and forwarded its report and recommendations to the Director of Public Prosecutions (DPP).

Eng. Kamau was initially charged with abuse of office and flouting tender regulations in a road contract.

However, a magistrate court’s order directed he be discharged instead of being acquitted.

He wanted the High Court to direct that the case be permanently terminated, following a successful appeal in 2017, which found that EACC was not properly constituted when it made recommendations to the DPP that he and others should be prosecuted.

Opposing Kamau’s application, the DPP stated that the rider in the Appellate Court’s decision stated parties are at liberty to proceed as long as there is a properly constituted EACC and within the law.
