Why Former Cabinet Member is Demanding Ksh16.2 Million From Gov Waiguru

Judy Kinyua, a former Kirinyaga County Executive Committee (CEC) member is now demanding Ksh16.2 million from Kirinyaga Governor Anne Mumbi Waiguru.

The former CEC in-charge of Gender, Culture and Social Services was sacked over incompetence and underperformance.

However, she has filed a petition at the Labour Relations court in Nyeri demanding at least Ksh16.2 million in compensation from Kirinyaga county government.

In her application on Tuesday, Kinyua indicated that her employment was terminated "arbitrarily and without justification" before the end of the Governor’s elective term, contrary to her expectations.

She further indicated that prior to her termination, she had made several financial commitments.

According to her lawyer Wahome Thuku, among the commitments Kinyua had made was securing a car loan of Ksh2 million.

The petitioner indicated that following the dismissal, she is faced with adverse financial effects.

The lawyer argued that the county chief denied Kinyua a fair hearing and did not give reasons for her termination.

“The Governor failed to exercise her authority in a manner that is consistent with the purpose and objects of the constitution as required under Article 73 (1) of the Constitution," Thuku stated.

Kinyua further argued that given that everyone has a right to fair labour practices, Waiguru and the county government denied her the right by suspending her in July and sacking her on August 20.

"Prior to the suspension from duty, the petitioner had not been given any warning, whether in writing or in any other form by the Governor, regarding her performance. She had never been summoned or interrogated by the County Assembly," the lawyer Thuku stated.
