Lawyer Ahmednasir Abdullahi Blasts CJ David Maraga Over Judiciary Mishaps

Senior Counsel Ahmednasir Abdullahi on Sunday launched a scathing attack against the Chief Justice and President of the Supreme Court of Kenya David Maraga.

Alleging extreme failure in the Judiciary, the lawyer expressed concern that the Court of Appeal is the only functional court in Kenya's judiciary.

"The Supreme Court is a pale shadow of its former self. The High Court is kaput (gone)," Ahmednasir quipped.

Besides, the counsel opined that the transformative agenda and progressive jurisprudence of the Ex-CJ Willy Mutunga's Court are now as subversive as MwaKenyas of the late 1980s.

Among the failures that saw Ahmednasir point fingers at CJ Mutunga is delayed judgments, failure to settle on hearing dates and routine denial of bail/bond.

"Corruption at an all-time high, unfriendly courts, winking to the Executive, judicial inertia, judges on go slow, gatekeepers everywhere," the Senior Counsel lamented.

"Why is the judiciary under CJ Maraga a carbon copy of the judiciary under KANU?" Ahmednasir posed.

In August, Maraga admitted that the judiciary was on the verge of losing its credibility due to delayed judgement.

"One of the cardinal principles in our Constitution is the expeditious delivery of justice. Justice delayed, is justice denied," Maraga began his address during the Annual Judges' Colloquium in Mombasa.

Maraga noted that if the delivery of justice to the sufferer is not timely, then it loses its importance and its a violation of their Human Rights.

Quoting Malaysian Constitutional lawyer Cyrus Das, Maraga noted: "Justice is a consumer product and must, therefore, meet the test of confidence, reliability and dependability like any other product if it is to survive market scrutiny.

"Credibility of the judiciary is at stake now due to mounting arrears of cases, delays in disposal and also the high cost of obtaining justice," the Chief Justice acknowledged.
