Former Nairobi Governor Evans Kidero on Wednesday took the Director of Public Prosecutions (DPP) Noordin Haji and the Ethics and Anti-Corruption Commission (EACC) to court over harassment.
Kidero filed a case accusing the EACC of obtaining several documents from his wife and children.
He stated that the search warrant was obtained with the aim to sustain an ongoing criminal case which he claims is facing imminent failure due to lack of evidence.
The former county head highlighted that he has been on the receiving end of threats, attacks, harassment, witch-hunt and intimidation by the EACC and DPP.
According to the former governor, the intimidation of his family is a plan to hurt him and asserted that it is a violation of his constitutional right.
He explained that the wealth he possessed was as a result of hard work over the years dating back to his first employment.
“The officers came armed with a search warrant dated 19th of this month, I was held hostage and falsely imprisoned in my own house with no consideration of my dignity, ” reads the court documents.
Kidero remarked that warrant was acquired without following due procedure and added that he was not granted any notice before the warrant was obtained to search his residence.
The politician further claimed that the search warrant was defective arguing that EACC has no authority to investigate the affairs of Mumias Sugar Company which is a private firm and not a public one.
This comes after the arrest of Kidero on September 20 after police officers and anti-corruption detectives raided his residence.
“I was arrested on the 9th of August. We’ve been to court twice and so far there has been no evidence.
"This morning EACC came with a search warrant to my house, it would appear to me that they are looking for evidence because did not have it in the first place,” stated the former governor.
