Lawyer Haron Ndubi Arrested for Hitting Police Motorcycle

City lawyer Haron Ndubi was, on Monday, charged in a Nairobi traffic court for hitting a police motorcycle and damaging it in the process.

According to the police, Ndubi was driving “without due care” along Langata road at around 11.30pm on Sunday when he hit police constable Simon Mungai’s motorcycle and injured him.

Appearing before Senior Resident Magistrate Ellen Riyiany, the prosecution team claimed that Ndubi drove on a public road without paying attention to other road users.

Furthermore, the prosecution charged the advocate with failing to obey verbal directives given to him by a police officer after refusing to blow into a breathalyzer.

Ndubi, through his lawyer John Khaminwa, tried to oppose taking a plea but the Magistrate declined his appeal.

He sought to challenge the traffic offence he was charged with, stating that it didn't exist in the law.

However, Magistrate Elector Riany stated that he could raise the same during the hearing of his case, noting that Ndubi was not a first-time offender.

The court ordered him to deposit a cash bail of Ksh 80,000 after which he was released pending the hearing of the case. The matter will be mentioned on Tuesday for purposes of taking a hearing date. 

Last year, Ndubi was arrested by police for alleged drunk driving after he was caught sleeping inside his car that was parked in the middle of Jakaya Kikwete Road. The case was, however, stopped by the High Court.

Ndubi was part of the legal team that challenged President Uhuru Kenyatta's victory in the repeat Presidential election of 2017.

He represented activists Njonjo Mue and Khelef Khalifa who eventually lost the case as the Supreme Court upheld Uhuru's win.
