Court Overturns Govt Boss' Ouster

The Communications Authority of Kenya Managing Director Francis Wangusi is set to remain in office after the High Court, on Tuesday, stopped acting Communications Authority CEO from taking over pending case determination.

The Labour Court also issued orders stopping any recruitment for the Director-General position from taking place at the CA pending hearing determination of the Cofek petition.

This was concerning a case that was taken to court by the Consumer Federation of Kenya (Cofek) challenging the legality of the appointment of the acting Director Ms. Mercy Njau. 

The board of Directors had appointed Ms. Njau after concluding that Wangusi had reached the mandatory retirement age, but Wangusi vowed to stay put saying that he still had one year left on his contract. 

This will deal a big blow to the chair of the CAK board, Mr. Gituku, who on May 28, 2019, announced the CA Director-General position as vacant.

A letter to Mr. Wangusi ordering him to clear out of his office by September 22 or be kicked out shows the infighting and intrigues that surround his tenure at the troubled CAK.

His contract came to an end on August 21, 2019, and according to the constitution, an independent selection panel was supposed to be put in place to appoint a new Director-General.

It rings true with Wangusi's insistence that the current CA board was not lawfully constituted and therefore could not appoint his replacement.

On August 22, 2019, Mr. Gituku and ICT Principal Secretary Jerome Ochieng' convened a press conference and unveiled Ms. Njau as the new CA boss.
