A Nairobi court on Monday, October 28, ordered the immediate closure of four popular entertainment establishments; Kiza Restaurant, B Club, Space Lounge and Explorers Tavern over noise pollution.
Justice Loice Komingoi of the Environment and Land Court in Nairobi declared the clubs' business permits illegal.
“A mandatory injunction is hereby issued against the 8th respondent (Nairobi County) compelling it to revoke all liquor licenses issued to the 1st, 2nd, 3rd and 4th respondents,” the ruling read in part.
This came after a section of Kilimani residents filed a complaint over the loud music played by the clubs in addition to the disturbance caused by the rowdy revellers.
The order would, however, be delayed in execution as the judge also issued a stay of execution for 30 days.
“However, I decline to grant the order of permanent injunction to restrain the 1st, 2nd, 3rd and 4th respondents from carrying on their business as they already have the necessary licenses duly issued. They are operating the businesses due to the licenses issued (albeit unlawfully),” added the court.
In the court documents, the residents claimed that the clubs' activities had deprived them of their sleep and security while being a bad influence on the moral development of their children.
“Some of the negative effects from the establishment are littering by patrons, obstruction, exposure to immoral and indecent behaviour by the patrons inside their vehicles,” the residents claimed.
