Baringo Senator Gideon Moi has taken action against Daily Nation after the newspaper defied his demands.
The Nation Media Group-publication ran a story on January 3, 2020, titled 'Moi Firm Linked to New KPA Tender Scam'.
Through TripleOKLaw, the senator sued the publication for defamation and sought orders compelling it to retract their story.
Moi, who had on January 10, 2020, demanded an apology from the respondents, stated that publication declined to render it and pull down the posts on social media.
"A permanent injunction restraining the defendants from publishing any further defamatory posts and/or statements in reference to the plaintiff," read the court statement.
The senator's lawyers stated that the article destroyed Moi's image and exposed him to public hatred, contempt and scandal.
"He has been disgraced, humiliated, subjected to untold embarrassment and ostracised in the eyes of Kenyans and members of the public for which he holds the defendants fully, wholly, jointly and severally responsible and liable," read Moi's suit papers.
The publication had alleged that Gideon was fraudulently awarded a tender by the Kenya Ports Authority.
He lamented that the story unfairly linked him to two companies - Mitchell Cotts and Nairobi Inland Container Depot (ICD) which landed the tenders without applying.
The story had also alleged that the Directorate of Criminal Investigations initiated the probe in December 2019, with senior KPA officials including managing director Daniel Manduku and Kenya Revenue Authority commissioner for customs Kevin Safari, reportedly appearing before the agency for grilling.
The senator added that he was not consulted before the publication run the story.
