Guard Fired for Disrespecting Matiang'i Loses Case

Daisy Cherogony, former Kenya Airports Authority (KAA) security guard who was fired for asking Interior CS Fred Matiang'i to queue for a security check at the Jomo Kenyatta International Airport on April 6, 2017, suffered a blow as the court upheld the disciplinary action against her.

Matiang'i, then Education CS, was denied preferential treatment, during the rainy day, as the CS and his entourage reportedly caused a disturbance as they sought access into Jomo Kenyatta International Airport.

A report by Business Daily on Tuesday, February 17, stated that Cherogony had sued KAA for unlawful sacking, seeking compensation worth Ksh 2.4 million.

“She was heard in terms of Section 41 and her rights under Article 41(1) safeguarded. 

"Since there was cause for the dismissal and basis for summary dismissal on account of gross misconduct, the suit is only fit for dismissal,” Justice Nzioki wa Makau ruled.

KAA had argued that the guard humiliated and mistreated the CS. Matiang'i allegedly was delayed for 24 minutes outside the terminal and almost missed his flight to Kisumu. 

"The claimant denied ever seeing the CS at the glass door and that if she had seen him, being a VIP she would have facilitated him as per the security procedures,” the agency stated via its lawyers in April 2017, after Cherogony filed the case.

The lawyers referred to a CCTV footage evidence which purported that Cherogony ignored the CS when he arrived at the terminal building.

The Standard in July 2017, reported that in her defence, she argued that she tried to calm down Matiang'i but her efforts were in vain. 

She further added that according to the airport security manual, CSs usually queue like ordinary passengers unless they have special passes, which require them to make special arrangements in advance.

The guard further argued that she was never shown any complaint letter from Matiang'i, neither was she given a chance to defend herself before her dismissal.
