A move by Director of Public Prosecutions Noordin Haji to withdraw criminal charges against Sports CS Amina Mohamed's brother and the wife was rejected by the courts, which argued that the duo faced serious charges over alleged land fraud and forgery charges.
A report by People Daily on Tuesday, March 10, detailed that Magistrate Rosalyne Aganyo ruled against Haji's request, ordering the case to proceed.
“I hereby disallow the application and do order that the matter shall proceed for hearing in the normal manner before this court to its conclusion.
"The offences facing the accused as charged are serious and involve land which is very emotive in Kenya today. It also pertains to proprietary rights protected by the constitution and the serious crimes such as those, in this case should proceed to final trial before a competent court of law,” Aganyo directed.
The duo was accused of conspiring to defraud one Francis Njeru of land worth Ksh75 million on October 19, 2015.
They were also charged with creating false documents while seeking to defraud Njeru another parcel of land valued at Ksh150 million.
The couple reportedly duped China Road and Bridge Corporation by claiming to be the rightful owners of the land. The wife did not take a plea and was directed to appear in court on May 7, 2020.
While ruling against Haji, the magistrate further argued that withdrawal of the charges would frustrate police efforts in combating crimes in the country and that Haji was not in a pole position to make such a request.
The magistrate wondered whether the DPP was acting on orders from above in making the request.
